Release and Hold Harmless Agreement
This Release and Hold Harmless Agreement is by and between the Participant/Guest and Golden Heart Hospitality, LLC DBA: Northern Sky Lodge. This Agreement shall become effective immediately after being accepted (by checking the box prompt when making a reservation on our website, or by maintaining your reservation if made through an OTA) by the Participant/Guest. This Release and Hold Harmless Agreement is effective in both the state of Alaska and the origin in which the Participant / Guest resides. This Hold Harmless Agreement shall be construed and upheld to the fullest extent allowed under the law in the origin in which the Participant/Guest resides. By signing your name, you take full responsibility for all guests or visitors that accompany you and or your stay. Northern Sky Lodge shall be referred to as the “Released Parties”. If any part or portion of this Hold Harmless Agreement is found to be considered an error then the remaining document shall stay effective and intact. The Participant/Guest signed below agrees to pay for all Northern Sky Lodge legal fees and charges that may occur from the Guests/Participants stay or participation in relation to this Hold Harmless Agreement.
I/My organization wish(es) to participate and/or stay at Northern Sky Lodge located at 8587 Parks Hwy, Fairbanks Alaska, 99709. I/My organization understand(s) that I do so at my/our own risk. I/My organization hereby release(s) Northern Sky Lodge, all employees, officers, agents, representatives and volunteers of the foregoing (all collectively referred to as the “Released Parties”) from liability for and hereby waive any and all claims for any loss, damage, injuries to person(s) or property, death, claims, demands, lawsuits, expenses and any other liability of any kind, or of to me or any other person, directly or indirectly arising out of or in connection with my/our participation and or stay at Northern Sky Lodge. I/My organization further agree to hold harmless, indemnify and reimburse the Released Parties from and for any sums, costs, or expenses incurred by any of the Released Parties or paid by them to any person (including me or my insurers) in connection with any accident loss, damage, injury to person or property, or death sustained by me or others in connection with my participation or stay at Northern Sky Lodge. This means that I/My organization will reimburse the Released Parties if anyone makes a claim against them based on damages or injuries to persons or property I/My organization may create or cause. Further, if I/My organization request(s) upon my/our own initiative to receive or purchase a guided tour of any kind I/My organization agree(s) to abide by all policies, state, local, and federal laws for the duration of the activity in which I/My organization is participating in and agree to hold Northern Sky Lodge harmless as stated above. I/My organization understand that failure to abide by these expectations may result in my/my organizations immediate removal from the activity or property and possible legal consequences may occur. As a participant and or guest, I/My organization also agree(s) to abide by all policies, procedures and rules as stated in the above policies for Northern Sky Lodge.
